International comparison of legal indicators shows a relatively low level of litigation in the Netherlands. This is quite surprising because legal aid (which is generally seen as improving the access to law) is much more generous than in the continental neighbouring countries. The paradox can be explained by features of legal culture on four levels: - to some degree on the level of positive law - much more so on the level of institutional infrastructure of lawyers, courts and 'alternatives to formal procedures' - behavioural patterns of professionals who deal with legal procedures - and last and least: legal consciousness of professionals as well as the genera/public. The data show that differences in legal behaviour are to be explained not so much on the demand side of the users of law, but rather on the supply side of judicial and quasi-judicial institutions.
